Following a clear mandate from our Partners and our Customers, Opb India Waste Management Private Limited (Opb India), in 2019, constituted a dedicated cross-functional compliance team and defined the roadmap to GDPR compliance.

What is GDPR?

The General Data Protection Regulation (GDPR), which came into effect from May 25, 2018, empowers European Union (EU) residents by placing them in control of their personal information and upholding strict protocols for organizations that collect and process this information.

The GDPR lays down seven core principles. They are:

  1. Lawfulness, fairness, and transparency
  2. Purpose limitation
  3. Data minimization
  4. Accuracy
  5. Storage limitation
  6. Integrity and confidentiality (security)
  7. Accountability

 

The Data We Collect

GDPR defines Data Controllers as an entity that determines the purposes for which and the means by which personal data is processed. Data Controllers decide ‘why’; and ‘how’; the personal data should be processed. The data processor processes personal data only on behalf of the Controller. Opb India  acts a Data controller or Data processor depending on the origin of the transaction.

For the transactions that originate on Opb India platform (Website, App), Opb India is Data controller. Opb India is Data processor where it processes data for its partners who are Data controllers. The data controllers specify the kind of data required from the data subject, i.e. the customer. As the data processor, we process data based on the requirements stated by Data controller.

This data can be of three types:

A. Personal Information (PI): That can identify a person. For instance, email id, mobile number, ID card number, and photo, etc.

B. Non-Personal Information (non PI): Such as the first name, last name, and device details, etc.

C. Sensitive Personal Information (SPI): Such as biometrics, genetic data, sexual orientation, race, and ethnicity, etc. Explicit Consent from Data Subjects

To ensure that our Customers are aware of why all the information is being collected, we have enabled; explicit consent; which has to be obtained from customers before processing their information. Moreover, our privacy policy clearly states ‘what’, ‘why’; and ‘how’; customers personal data is processed.

Data Subject Rights
Opb India has implemented processes to acknowledge and respect Data Subject Rights. A data subject can email us at “info@opbindia.com” and request to exercise Data Subject Rights. Since Opb India is both Data controller and Data Processor (processing data at the behest of Data Controllers), the verification authority to validate the Customers Data Subject Right request is decided basis the origin of transaction.

8. Rights related to automated decision-making and profiling

Data Management

A. Data Storage and Security: Opb India is hosted on Hostinger and has put in place industry standard practices for managing the data in transit and data at rest.

B. Data retention: Opb India maintains data from the transactions enabled on its own platform and the ones enabled on Widgets/Apps enabled for partners. The retention period is defined in accordance with the business and legal needs. We however understand and appreciate the needs to provide flexibility to Data controllers to define data retention period for their own customers. Such provisions are agreed and defined in the contract between the Partners (Data Controller) and Opb India (Data Processor).

The time-frames can be specified in the contract based on the partner’s specific requirements. The partner can choose to have the data deleted from our cloud-based servers as desired. After the termination or expiry of the contract, the partner can place a request to remove all data by writing to us at “info@opbindia.com”. We validate the request and, if needed, seek confirmation from the partner before processing the request. Opb India Customers can also request for deletion of their credentials by writing to us at “info@opbindia.com”. After validating the request, the details are deleted within 15 days of receiving customer request.

C. Data Breach Management:  We continually monitor and upgrade our systems and processes to maintain the highest standards of data management and privacy practices. In an unlikely event of a data breach, we intend to notify our partner (Data Controllers) and Data subject (where Opb India is Data controller) immediately and no later than 24 hours after becoming aware of such a breach.

Our commitment to world-class standards, In order to meet the world class standards for Data Privacy and Data Security, Opb India has taken steps to be General Data Protection Regulation (GDPR) compliant. Opb India is committed to aligning itself with global best practices in data compliance and is dedicated to infosec and data privacy. To that end, the company has a dedicated team working on these requirements.

Return Policy

Replacement is a scheme provided by respective sellers directly under this policy in terms of which the option of exchange, replacement and/ or refund is offered by the respective sellers to you.

If the buyer faces any problem with the product, he/she will have the option to use the return policy as specified by the seller.

This Return Policy covers the buyer against ‘damaged’, ‘defective’ and ‘not as described’ products – for both, brand new and refurbished segments.

At opbindia, we take our customer’s satisfaction seriously. If you receive a product that is missing, broken, or different from your order, please send us an unboxing video and a photo within 48 hours of delivery to support@opbindia.com. For defective products, please send us a photo and video within 72 hours. We will do our best to resolve the issue and provide a replacement or refund.

Should a customer wish to submit a replacement request for a second time, subsequent to having filed a replacement request for a previous order, it is a requisite that the customer submits their request for the second order within a time frame not exceeding 24 hours from the point of delivery or receipt of the order. Failure to initiate the replacement request within this specified time frame may result in the customer forfeiting their eligibility for a replacement.

Refund is only approved in case Replacement is not available with Sellers.

For all products, the policy on the product page shall prevail over the general returns policy.

The exchange and replacement will be subject to availability of the stock.

No Return Categories– Products in this category are not returnable due to their nature or other reasons.

1. All software versions & updates will be basis Brand Policy & guidelines. Opbindia is not responsible for any such guidelines or policy changes by the Brands.

In order to help you resolve issues with the product, the seller’s authorized personnel may troubleshoot your product either through online tools, over the phone, and/or through an in-person technical visit.

After pick-up, the product will be checked for the following conditions once the same is received by seller:

Complete Product All in-the-box accessories (like chargers, cable, etc.), as applicable, freebies and combos (if any) should be present.
Unused Product The product should be unused, without any stains and with non-tampered quality check seals/return tags/warranty seals (wherever applicable). Before returning a mobile/ laptop/ tablet, the device should be formatted and screen lock (pin, pattern or fingerprint) must be disabled.
Undamaged Product The product (including SIM trays/ charging port/ headphone port, back-panel etc.) should be undamaged and without any scratches, dents, tears or holes.
Undamaged Packaging Product’s original packaging/ box should be undamaged.

Replacement / Refund shall be processed only in case if the above conditions are met. We would request you to please ensure above for faster processing of your replacement/refund.

The damage conditions for the refurbished products shall be as provided on the product page.

The field executive will refuse to accept a return if any of the above conditions are not met.

For any products for which a refund is to be given, the refund will be processed once the returned product has been received by the seller.

2. If I request for a replacement, when will I get it?

The replacement is initiated after the original delivered item is picked up. Please check the SMS & email we send you for your replacement request for more details or can visit our Helpdesk on any working days.

3. Can items be returned after the time period mentioned in the Returns Policy?

No, sellers will not be able to accept returns after the time period mentioned in the returns policy.

4. Do I have to return the accessories when I return a product?

Yes, the accessories if any has to be returned along with the product.

5. What should I do if I have an issue with my product after the return period?

All products sold on Opbindia are covered under limited warranty for a period as described in the warranty card or website at the time of purchase of device. You are requested to log your support ticket for warranty by calling us @ +91 11-42471166 or write to us at support@opbindia.com

  • Where do I send my return?

1. What is the Condition Of Refund?

Refund is only initiated in case the product is returned within return period window (3 days from the date of delivery) for the reasons specified as below.

  1. Mismatch in Product received with respect to product ordered
  2. Functional defect in the product
  3. Replacement not available or replacement not being availed.
  4. The grade mentioned on website doesn’t matches with the grade of phone delivered.

2. My bank is still deducting EMI even though I have cancelled my order, why?

Please get in touch with your card issuing bank and they will help you out.

3. My order has been cancelled, when will I get my refund?

Once your order is cancelled and you receive a confirmation from us saying that your refund has been initiated, it will be credited as per the following timelines depending on your mode of payment. Refund will be credited to the same mode from which you made payment and takes 7-10 days to reflect depending on banks.

4. I have returned my product, when will I get my refund?

Refund is initiated once the device is received by the seller. It takes 7-10 days of time to reflect in the bank account / credit card / or the payment mode depending on the bank.

6. How will I get my refund for returning an item I paid for with Pre-Booking /Prepaid Option?

For your ‘ Pre-Booking/Prepaid ‘ order, you will get the amount refunded to your bank account. You can update your bank account details with our Helpdesk while opting for a refund.

  • How long will the Cycle take?

General Rules for a Successful Return

  1. In certain cases where the seller is unable to process a replacement for any reason whatsoever, a refund will be given.
  2. During open box deliveries, while accepting your order, if you received a different or a damaged product, you will be given a refund (on-the-spot refunds for cash-on-delivery orders). Once you have accepted an open box delivery, no return request will be processed, except for manufacturing defects.   3. For Furniture, any product-related issues will be checked by authorized service personnel (free of cost) and attempted to be resolved by replacing the faulty/ defective part of the product. Full replacement will be provided only in cases where the service personnel opine that replacing the faulty/defective part will not resolve the issue.

Wrong Delivery – (Customer received delivery message, product not delivered):

‘In case the product was not delivered, and you received a delivery confirmation email report the issue within 7 days from the date of delivery confirmation for the seller to investigate.’

In the event of any breach of this warranty, the Customer’s sole and exclusive remedy, and Opb India’s sole and exclusive liability, shall be (at Opb India’s option) to remedy the failure or to refund the monetary amount paid for the services by the Customer, if any. Except as set forth in the foregoing sentence, we make no representations or warranties of any kind regarding the Services or the Opb India Property. We expressly disclaim any and all warranties, whether express or implied, including: all warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any and all warranties arising from course of dealing and usage of trade; that the services and Opb India property will meet your requirements, will always be available, accessible, uninterrupted, timely, secure or operate without error, as to the results that may be obtained from the operation, use or other exploitation of the services or Opb India property, and as to the accuracy or reliability of any information obtained from the services or the Opb India property. No advice or information, whether oral or written, obtained not expressly stated herein.

Under no circumstances will you be entitled to recover from us any incidental, consequential, indirect, punitive or special damages (including damages for loss of business, loss of profits or loss of use), whether based on contract, tort (including negligence), or otherwise arising from or relating to the services or Opb India property, even if Opb India has been informed or should have known of the possibility of such damages. in any event, Opb India’s maximum aggregate liability for any and all damages arising from the services or the Opb India property shall be a refund of the amount paid by you to us, if any.

Some jurisdictions do not allow the limitation or exclusion of warranties or of liability, so some of the above limitations or exclusions may not apply to you.

8.Indemnity.

Customer agrees to indemnify and hold Opb India, our affiliates, suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them harmless, including costs, liabilities and legal fees, from any claim or demand made by any third party due to or arising out of (i) your access to or use of Services, (ii) your violation of these Terms & Conditions, or (iii) the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity. Opb India reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Opb India. We will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

09. Applicable Law, Jurisdiction, Compliance

You and Opb India agree that all matters arising from or relating to the use and operation of the Site and/or the Services will be governed by the substantive laws of Republic of India, without regard to its conflicts of laws principles. You agree that all claims you may have arising from or relating to the operation, use or other exploitation of the Site and/or the Services will be heard and resolved in the courts located in New Delhi. You consent to the personal jurisdiction of such courts over you, stipulate to the fairness and convenience of proceeding in such courts, and covenant not to assert any objection to proceeding in such courts.

10. Miscellaneous Provisions

You agree that the electronic text of these Terms & Conditions constitutes writing and your assent to the terms and conditions hereof constitutes a “signing” for all purposes.

11. Information Collection, Use, and Sharing

By submitting any Opb India contact form, you understand that you may be contacted by a Opb India representative or a representative from the partner you’ve chosen. You may be contacted via telephone, email, text, or prerecorded message regarding Opb India programs, offers, events, announcements, and offers from Opb India’s third party marketing partners. If you respond to any such offer, your information will be subject to that third party’s terms and conditions. By providing us your phone number, you grant Opb India permission for the use of text messages, prerecorded voice or and/or automatic telephone dialing systems to contact you and/or deliver Opb India related information, offers or announcements.

Warranty Policy

OPB INDIA offers you a 6 month full warranty on every mobile repaired/replaced by us from the date of invoice.

To claim your warranty, you need to:

  1. Share the video of the phone with the prevailing display issue at support@opbindia.com
  2. Send us your phone number/order number/IMEI Number. Just about any of it at support@opbindia.com

How can I claim my warranty?

You can claim the warranty by writing to us at support@opbindia.com with the service details and the invoice delivered to you at the time of repair. If you need any further assistance, please connect via Chat or write to us at support@opbindia.com

How much time will Opb India Repair take to resolve my query, if it is coming under warranty?

Our team generally resolves an issue within 48 hours to 72 hours from the moment you send us a query. You will get acknowledgement over mail for your query and your issue will be sorted as soon as possible.

Warranty is limited to the parts and/or service(s) that were paid for. If only parts were purchased, warranty is limited to the replacement of the parts. If parts and repair service were purchased, warranty extends to cover the labor cost of part replacement and any other repairs specifically resulting from the initial repair.

The warranty is not applicable under the following scenarios :

  1. We do not cover any kind of accidental damage and our warranty stands null and void in all such related cases. Direct damage or damages caused as a consequence of accidents will not be covered under the 6 month warranty.
  2. Any display issues that may arise without any manual intervention and are related to the screen quality specifically visible lines and blank screen
  3. Excessive Damage to the device wherein there is a possibility that internal components might have been affected due to excessive or critical damage to the device or screen. Such excessive visible damage might lead to internal components getting damaged and can cause screen or other system malfunctions. Any part replacement wherein such damage is reported at the time of order completion will not be covered under the warranty provided. Such malfunctions can even become visible after immediately opening of the device and reassembly as any component damage/malfunction would become visible after opening the device and reassembly, Opb India Repair or any of its representative will neither be responsible nor liable for such issues.
  4. Subsequent mishandling which causes the frame to bend, twist, or crack will not be entertained
  5. Subsequent mishandling with the screen such as hard press that may initiate discoloring or lining on the display
  6. Subsequent accidental or purposeful drops
  7. Water damage
  8. Tampering with internal hardware
  9. Damage resulting from attempted customer self-repairs
  10. Software issues unrelated to the repair
  11. Jail-broken devices
  12. New damages unrelated to the original repair
  13. Any loss of data occurring as a result of the repair – customers are advised to back up all data prior to the repair attempt

Our warranty also does not cover the outcome of a repair if certain pre-repair conditions exist, including:

  1. Existence of known manufacturing and/or performance issues related to the device separate from repair, as noted prior to the repair
  2. Existence of damage to the device frame, as noted prior to the repair
  3. Water damage
  4. Jail-broken devices
  5. Tampering with internal hardware: Under certain conditions, internal damage may make a repair impossible. Our specialist will be able to explain in detail upon diagnosing your specific device. If you have any doubts, we recommend that you do not attempt to repair the device on your own, as any damage may affect the reparability of your device.

You conduct your actual sales and other transactions directly with the third parties and, unless otherwise specifically and clearly indicated, not with opbindia. As a result, opbindia cannot control any aspect of your sales and transactions with third parties, and the third parties are solely responsible to you for all aspects of your sales and transactions with them and consequently opbindia will have no liabilities towards the sellers or buyers in this regard. in document below “we”, “our”, “us” is used for opbindia and opbindia’s third party buyer collectively.

1. You certify that you are the legal owner of the gadget that you want to sell.

2. All initial quotes are pending our evaluation of your gadget and no binding offer is made until we have had a chance to inspect the gadget. We reserve the right to refuse to offer to purchase any item that you offer to sell for any reason we deem, in our sole discretion, to be sensible. We reserve the right to change our quote at any time.

3. Should you be given a quote via our website/app/affiliates AND we, upon inspection of your gadget, agree to pay you that quoted amount, you are legally and contractually bound to sell us the gadget for the price quoted via the website.

4. Should you be given a quote via our website/app and upon inspection your gadget is A) a different model than originally quoted, B) missing any parts, C) in a different condition than stated, we, in instances mentioned heretofore and beyond, reserve the right to change our offer.

5. All gadgets sold must compulsorily be attached with the following documents:
a. self-attested ID-proof (government approved) of owner of old gadget;
b. self-attested indemnity bond provided by us if required;

6. Lawful Sales Only. You must own the right, title and all legal interest in the gadget or other articles you sell us. Your sale and/or, shipment of any such article must not violate any law, regulation or statute of any jurisdiction. You may not unlawfully transfer or encumber any intellectual property, trademark, copyright, patent, software, license or other legal right or restriction via your shipping or selling of the picked-up article. The article you sell must be free of all legal restrictions that would affect the value of the article, restrict your legal right to transfer ownership of the article (including the article itself, softwares present on the article, or hardware on or inside the article). You must refrain from violating any export laws or restrictions. The article you sell (including all related materials, software and add on hardware) may not be counterfeited, stolen, or contain harmful or offensive content of any nature. You agree to indemnify and hold opb india, our affiliates, suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them harmless, including costs, liabilities and legal fees, from any claim or demand made by any third party due to or arising out of (i) your access to or use of Services, (ii) your violation of these Terms & Conditions,

7. It is also your responsibility to wipe, clean or delete data on your Gadget being sold via Opb India. You confirm that all the data in the said device will be erased before handing it over. You also confirm that in spite of erasing the data manually/electronically, if any data still accessible due any technical reason, Opb India or the Third party buyer shall not be responsible for the same and you will not approach Opb India for any retrieval of the data.

8. You understand once a device is sold by you via Opb India, in no scenario can this device be returned back to you.

9. You understand that Products distributed as gifts from state sponsored or NGO funded distribution programs are not accepted on Opb India platform.

10.We reserve the right to modify this agreement at any time without giving you prior notice. Your use of our website/app, any of our tools and services, following any such modification constitutes your agreement to follow and be bound by the Agreement as modified. Terms and conditions modifying the Agreement are effective immediately upon publication

11.Opb India reserves the right to cancel any transaction that is deemed suspicious or fraudulent on the organisation’s own discretion.

Terms of Use for Repair of Product

The Services constitute a technology platform that connects users of Opb India (“Opb India Waste Management Pvt Ltd) mobile applications or websites provided as part of the Services (each, an “Application”) who are seeking gadget (Phones, tablet, Laptop etc) repair services to a network of third party repair technicians, including, without limitation, independent third party repair technicians and third party logistics providers under agreement with Opb India (“Third Party Professionals”). The Services are made available solely for your personal/ non-commercial use unless agreed otherwise, in writing in a separate agreement with you.

You acknowledge and agree that Opb India does not provide gadget repair services or logistics or function as a gadget repair services company. Our services are to be used by you, if at all, for the purpose of requesting and scheduling gadget repair services or logistics services with third party professionals, but you agree that Opb India has no responsibility or liability to you related to any gadget repair services or logistics provided to you by the third party professionals through the use of the services

Opb India does not guarantee the suitability, safety or ability of third party professionals. It is solely your responsibility to determine if a third party professional will meet your needs and expectations. under no circumstances will Opb India participate in disputes between you and a third party professional. by using the services, you acknowledge that you may be exposed to situations involving third party professionals that are potentially unsafe, offensive, harmful to minors, or otherwise objectionable, and that your use of third party professionals arranged or scheduled using the services is at your own risk and judgment. Opb India shall not have any liability whatsoever arising from or in any way related to your transactions or relationship with third party professionals.

Payment for Services

You understand and agree that usage of the Services may result in payments by you for the services you receive from a Third Party Professional (“Charges”). After you have received services, , Opb India will facilitate payment of the applicable Charges on behalf of the Third Party Professional, solely as the Third Party Professional’s limited payment collection agent, using the preferred payment method you have designated while initiating or modifying your Account, and will send you a receipt vide email at the end of each session. By utilizing the Services, it is understood and agreed that payment of the Charges in such manner shall be considered the same as payment made directly by you to the Third Party Professional(s). Charges will be inclusive of applicable taxes wheresoever required by law. Charges paid by you are final and non-refundable, unless otherwise determined by Opb India in its sole discretion. While you do retain the right to request lower Charges from a Third Party Professional for services received by you from such Third Party Professional at the time you receive such services from the Third Party Professional, Opb India will respond accordingly to any request from a Third Party Professional to modify the Charges for a particular service.

You understand and agree that (i) all Charges are due immediately and (ii) payment will be facilitated by Opb India using the preferred payment method you have designated while initiating or modifying your Account. If your primary account payment method is determined to not able to be charged for any reason whatsoever, you agree that Opb India may, as the Third Party Professional’s limited payment collection agent, use a secondary payment method in your account, if available.

Opb India reserves the right to establish, remove and/or revise charges for any or all aspects of the Services at any time at Opb India’ sole discretion. Opb India will use reasonable efforts to inform you of charges that may apply, provided that you will be responsible for Charges incurred under your account regardless of your awareness of such charges or the amounts thereof. We may from time to time provide certain users with promotional offers and discounts that may result in different charges for the same or similar services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the services or the charges applied to you. You may choose to cancel your request for services from a Third Party Professional at any time prior to such Third Party Professional’s arrival.

Repair Clauses for iOS users:

1. We do not necessarily use original Apple parts to repair the phone.
2. Please note that repairing your phone on Opb India will void the Apple warranty.

WARRANTY

The Third Party Professional provides you with a minimum 30 day warranty ( More than 30 days if specified in order) on the gadget repair services as follows: (a) Screen/LCD and/or any other repaired or replaced parts that malfunction, or does not work as intended or designed to work, and (b) the warranty provided is limited to the parts and/or service(s) that you paid for. Except, as otherwise provided in these Terms, the warranty extends to cover the labour cost of part replacement and any other repairs specifically resulting from the initial repair.

The warranty set forth above does not protect against: (a) Your actions that cause damage to the device that was repaired by the Third Party Professional

(b) Software issues unrelated to the repair

(c) Devices that have been jailbroken

(d) Any loss of data occurring as a result of the repair (YOU ARE ADVISED TO BACK UP ALL DATA PRIOR TO ANY REPAIR ATTEMPT)

(e) Any issue you knew about and advised the Third Party Professional or Opb India related to the device distinct from the repair, and noted prior to the repair being made

(f) Water damage

The warranty set forth in these Terms is valid only for the specific device repaired and the original customer. Under no circumstances is the warranty transferable to different devices or to an individual that is not you.

While you will notify Opb India of any warranty claim, and Opb India will thereafter notify the Third Party Professional of the need to investigate the warranty claim, liability for performing the warranty repair services will rest solely with the Third Party Professional who performed the repair service. By using the Services, you are authorizing the Third Party Professional to perform repair work on your cellular phone or tablet device or any other article. You understand that neither Opb India nor the Third Party Professionals are Authorized Service Providers (ASP) of any cellular phone or tablet manufacturer, including but not limited to Apple Inc., and that neither Opb India nor the Third Party Professional are in any way affiliated with the gadget manufacturer, including but not limited to Apple Inc. Further, by using the Services you agree to release, indemnify, and hold Opb India harmless from liability for any claims or damages of any kind or description that may arise from any gadget device repair work performed on your device unless it is caused by the gross negligence of the Third Party Professional.

By utilizing the Services you understand that Opb India has no liability for any data loss, which may occur as a result of work done on your device. You also understand that you have the option to, and are responsible for backing up your device before allowing the Third Party Professional to perform repair work on your device.

By availing the Services you understand that any repairs or technical assistance rendered by the Third Party Professional may void manufacturer warranties for the device repaired, and that Opb India will not assume any liability or warranty in the event that the manufacturer warranties stand abated. Opb India and the Third Party Professionals have no liability whatsoever for indirect or consequential damages resulting from a repair or repair attempt, including any lost or damaged data, software, or lost profits or revenue of the customer.

Opb India will warrant to you that from the date the repair Services are provided to you till a period of minimum 30 days , so long as you remain the owner (“Warranty Period”), each part and accessory provided to you as a component of the repair performed by the Third Party Professional under these Terms will be materially free of manufacturing defects. Opb India’ sole obligation, and your sole remedy, under this warranty is limited to, at Opb India’ sole discretion, repair or replacement of the defective part or accessory provided as a component of the repair. This warranty under these Terms is non-transferable.

Please note that Opb India obligations under the warranty contained in these Terms are conditioned on your prompt notification to both the Third Party Professional AND Opb India of any warranty claim and complying with Opb India’ then-current warranty procedures provided to you.

PLEASE NOTE:

Some jurisdictions do not allow limitations on implied warranty, so the limitations and exclusions in this section may not apply to you. Your statutory rights that cannot be waived, if any, are not affected by these provisions. You agree and acknowledge that the limitations and exclusions of liability and warranty provided in these terms of use are fair and reasonable.
