Return Policy

Replacement is a scheme provided by respective sellers directly under this policy in terms of which the option of exchange, replacement and/ or refund is offered by the respective sellers to you.

If the buyer faces any problem with the product, he/she will have the option to use the return policy as specified by the seller.

This Return Policy covers the buyer against ‘damaged’, ‘defective’ and ‘not as described’ products – for both, brand new and refurbished segments.

At opbindia, we take our customer’s satisfaction seriously. If you receive a product that is missing, broken, or different from your order, please send us an unboxing video and a photo within 48 hours of delivery to support@opbindia.com. For defective products, please send us a photo and video within 72 hours. We will do our best to resolve the issue and provide a replacement or refund.

Should a customer wish to submit a replacement request for a second time, subsequent to having filed a replacement request for a previous order, it is a requisite that the customer submits their request for the second order within a time frame not exceeding 24 hours from the point of delivery or receipt of the order. Failure to initiate the replacement request within this specified time frame may result in the customer forfeiting their eligibility for a replacement.

Refund is only approved in case Replacement is not available with Sellers.

For all products, the policy on the product page shall prevail over the general returns policy.

The exchange and replacement will be subject to availability of the stock.

No Return Categories– Products in this category are not returnable due to their nature or other reasons.

1. All software versions & updates will be basis Brand Policy & guidelines. Opbindia is not responsible for any such guidelines or policy changes by the Brands.

In order to help you resolve issues with the product, the seller’s authorized personnel may troubleshoot your product either through online tools, over the phone, and/or through an in-person technical visit.

After pick-up, the product will be checked for the following conditions once the same is received by seller:

Correct Product	IMEI/ name/ image/ brand/ serial number will be matched.
Complete Product	All in-the-box accessories (like chargers, cable, etc.), as applicable, freebies and combos (if any) should be present.
Unused Product	The product should be unused, without any stains and with non-tampered quality check seals/return tags/warranty seals (wherever applicable). Before returning a mobile/ laptop/ tablet, the device should be formatted and screen lock (pin, pattern or fingerprint) must be disabled.
Undamaged Product	The product (including SIM trays/ charging port/ headphone port, back-panel etc.) should be undamaged and without any scratches, dents, tears or holes.
Undamaged Packaging	Product’s original packaging/ box should be undamaged.

Replacement / Refund shall be processed only in case if the above conditions are met. We would request you to please ensure above for faster processing of your replacement/refund.

The damage conditions for the refurbished products shall be as provided on the product page.

The field executive will refuse to accept a return if any of the above conditions are not met.

For any products for which a refund is to be given, the refund will be processed once the returned product has been received by the seller.

No, sellers will not be able to accept returns after the time period mentioned in the returns policy.

4. Do I have to return the accessories when I return a product?

Yes, the accessories if any has to be returned along with the product.

5. What should I do if I have an issue with my product after the return period?

“OPB INDIA” owns and operates the website, www.opbindia.com. The mobile touch versions, App on Play store and Apple App store and/or any site(s) we have now or in the future that reference these Terms & Conditions (collectively, “OPB INDIA”), provides a marketplace and platform for consumers to buy Electronic Devices, Like Mobile phone, Laptop, TV, Electronic Accessories etc.

If you do not agree with any part of these Terms & Conditions, you must not use the Site or Services. Your continued use of the Site or Services will constitute your acceptance of these Terms & Conditions, as they may be modified by us from time to time, with or without notice to you. 1. Permitted Use and Compliance with Laws.

You conduct your actual sales and other transactions directly with the Third Parties and, unless otherwise specifically and clearly indicated, not with Opb India. Opb India values and protects the privacy of your information. Please review the Opb India privacy policy, as it contains important information relating to your use of the Site and Services. You agree that you will notify Opb India immediately if you believe that a third party has obtained your User ID or password, or if you believe that any unauthorized access or use may occur or has occurred. 5. Membership.

a.Registration and Basic Membership Terms: Members are visitors to the site and or those using the Services that choose to register with Opb India (“Members”). Once registered, an account is created for each Member (“Account”). If you choose to register as a Member, you represent and warrant to us that:

(i) you are of legal age to form a binding contract

(ii) you will provide us with accurate, current and complete registration and contact information, and keep your information updated

(iii) your registration and your use of the Services are not prohibited by law. We reserve the right to suspend or terminate your membership, or your access to the Site and or Services, in the event that you breach any of the Terms & Conditions or other applicable Opb India policies.

b. Password and Account Security: In connection with your Account, you will create a password and a user id. You are responsible for keeping your password and secure, and you are responsible for all actions taken using your password.

c. Age: To create an Account or to otherwise use this Website, you must be at least eighteen (18) years old or the age of majority in your state or province of residence, whichever is greater.

6. Inactive Accounts

a. Inactive Status: A Member’s Account may be set to inactive if there is no activity associated with that Account for 180 days.

7. Warranty Exclusions and Limitations of Liability.

We warrant that the Services and Opb India Property will conform substantially to the descriptions set forth on the Site. In the event of any breach of this warranty, the Customer’s sole and exclusive remedy, and Opb India’s sole and exclusive liability, shall be (at Opb India’s option) to remedy the failure or to refund the monetary amount paid for the services by the Customer, if any. Except as set forth in the foregoing sentence, we make no representations or warranties of any kind regarding the Services or the Opb India Property. We expressly disclaim any and all warranties, whether express or implied, including: all warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any and all warranties arising from course of dealing and usage of trade; that the services and Opb India property will meet your requirements, will always be available, accessible, uninterrupted, timely, secure or operate without error, as to the results that may be obtained from the operation, use or other exploitation of the services or Opb India property, and as to the accuracy or reliability of any information obtained from the services or the Opb India property. No advice or information, whether oral or written, obtained not expressly stated herein.

Under no circumstances will you be entitled to recover from us any incidental, consequential, indirect, punitive or special damages (including damages for loss of business, loss of profits or loss of use), whether based on contract, tort (including negligence), or otherwise arising from or relating to the services or Opb India property, even if Opb India has been informed or should have known of the possibility of such damages. in any event, Opb India’s maximum aggregate liability for any and all damages arising from the services or the Opb India property shall be a refund of the amount paid by you to us, if any.

Some jurisdictions do not allow the limitation or exclusion of warranties or of liability, so some of the above limitations or exclusions may not apply to you.

8.Indemnity.

Customer agrees to indemnify and hold Opb India, our affiliates, suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them harmless, including costs, liabilities and legal fees, from any claim or demand made by any third party due to or arising out of (i) your access to or use of Services, (ii) your violation of these Terms & Conditions, or (iii) the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity. Opb India reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Opb India. We will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

09. Applicable Law, Jurisdiction, Compliance

You and Opb India agree that all matters arising from or relating to the use and operation of the Site and/or the Services will be governed by the substantive laws of Republic of India, without regard to its conflicts of laws principles. You agree that all claims you may have arising from or relating to the operation, use or other exploitation of the Site and/or the Services will be heard and resolved in the courts located in New Delhi. You consent to the personal jurisdiction of such courts over you, stipulate to the fairness and convenience of proceeding in such courts, and covenant not to assert any objection to proceeding in such courts.

10. Miscellaneous Provisions

No delay or omission by us in exercising any of our rights occurring upon any noncompliance or default by you with respect to any of these Terms & Conditions will impair any such right or be construed to be a waiver thereof, and a waiver by us of any of the covenants, conditions or agreements to be performed by you will not be construed to be a waiver of any succeeding breach thereof or of any other covenant, condition or agreement hereof contained. As used in these Terms & Conditions, “including” means “including but not limited to.” If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be invalid or unenforceable, then these Terms & Conditions will remain in full force and effect and will be reformed to be valid and enforceable while reflecting the intent of the parties to the greatest extent permitted by law. Except as otherwise expressly provided herein, these Terms & conditions set forth the entire agreement between you and Opb India regarding its subject matter, and supersedes all prior promises, agreements or representations, whether written or oral, regarding such subject matter. You agree that the electronic text of these Terms & Conditions constitutes writing and your assent to the terms and conditions hereof constitutes a “signing” for all purposes.

11. Information Collection, Use, and Sharing

By submitting any Opb India contact form, you understand that you may be contacted by a Opb India representative or a representative from the partner you’ve chosen. You may be contacted via telephone, email, text, or prerecorded message regarding Opb India programs, offers, events, announcements, and offers from Opb India’s third party marketing partners. If you respond to any such offer, your information will be subject to that third party’s terms and conditions. By providing us your phone number, you grant Opb India permission for the use of text messages, prerecorded voice or and/or automatic telephone dialing systems to contact you and/or deliver Opb India related information, offers or announcements.

You also agree that Opb India may attempt to contact you via any telephone number you provide, even if it is a mobile telephone number which may result in charges to you. You can opt out from Opb India email and messaging services at any time by writing to info@opbindia.com .

You understand that agreeing to run diagnostics on the Opb India app program will allow Opb India access to your device, solely in relation to conducting the assessment of the quality parameters of your device. In no matter will your private information and data on the device will be accessed for any other purpose and that such information shall not be downloaded by the Company or used in any other manner.

Warranty Policy

OPB INDIA offers you a 6 month full warranty on every mobile repaired/replaced by us from the date of invoice.

To claim your warranty, you need to:

1. Share the video of the phone with the prevailing display issue at support@opbindia.com
2. Send us your phone number/order number/IMEI Number. Just about any of it at support@opbindia.com

How can I claim my warranty?

You can claim the warranty by writing to us at support@opbindia.com with the service details and the invoice delivered to you at the time of repair. If you need any further assistance, please connect via Chat or write to us at support@opbindia.com

How much time will Opb India Repair take to resolve my query, if it is coming under warranty?

Our team generally resolves an issue within 48 hours to 72 hours from the moment you send us a query. You will get acknowledgement over mail for your query and your issue will be sorted as soon as possible.

Warranty is limited to the parts and/or service(s) that were paid for. If only parts were purchased, warranty is limited to the replacement of the parts. If parts and repair service were purchased, warranty extends to cover the labor cost of part replacement and any other repairs specifically resulting from the initial repair.

The warranty is not applicable under the following scenarios :

1. We do not cover any kind of accidental damage and our warranty stands null and void in all such related cases. Direct damage or damages caused as a consequence of accidents will not be covered under the 6 month warranty.
2. Any display issues that may arise without any manual intervention and are related to the screen quality specifically visible lines and blank screen
3. Excessive Damage to the device wherein there is a possibility that internal components might have been affected due to excessive or critical damage to the device or screen. Such excessive visible damage might lead to internal components getting damaged and can cause screen or other system malfunctions. Any part replacement wherein such damage is reported at the time of order completion will not be covered under the warranty provided. Such malfunctions can even become visible after immediately opening of the device and reassembly as any component damage/malfunction would become visible after opening the device and reassembly, Opb India Repair or any of its representative will neither be responsible nor liable for such issues.
4. Subsequent mishandling which causes the frame to bend, twist, or crack will not be entertained
5. Subsequent mishandling with the screen such as hard press that may initiate discoloring or lining on the display
6. Subsequent accidental or purposeful drops
7. Water damage
8. Tampering with internal hardware
9. Damage resulting from attempted customer self-repairs
10. Software issues unrelated to the repair
11. Jail-broken devices
12. New damages unrelated to the original repair
13. Any loss of data occurring as a result of the repair – customers are advised to back up all data prior to the repair attempt

Our warranty also does not cover the outcome of a repair if certain pre-repair conditions exist, including:

1. Existence of known manufacturing and/or performance issues related to the device separate from repair, as noted prior to the repair
2. Existence of damage to the device frame, as noted prior to the repair
3. Water damage
4. Jail-broken devices
5. Tampering with internal hardware: Under certain conditions, internal damage may make a repair impossible. Our specialist will be able to explain in detail upon diagnosing your specific device. If you have any doubts, we recommend that you do not attempt to repair the device on your own, as any damage may affect the reparability of your device.

Note: Refund is not applicable to the spare part as on screen. Please refer to your order email for more information.

Opb india is solely located in, and operates from, India. Additionally, we host our Services and process your Personal Data solely in the India. However, it is possible that some of the service providers referenced above may process Personal Data outside your jurisdiction, and in countries that are not subject to an adequacy decision by the European. Commission or your local legislature and/or regulator, and that may not provide for the same level of data protection as your jurisdiction. We ensure that the information continues to be protected wherever it is located in a manner consistent with the

standards of protection required under applicable law, for instance by entering into the appropriate back-to-back agreements and, if required, standard contractual clauses for the transfer of data as approved by the European Commission (Art. 46 GDPR).

Minors

OPB INDIA Services are solely intended for business clients and are not directed at minors. Transaction on the Platform is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Platform. If you are a minor i.e. under the age of 18 years, you may use the Platform or access content on the Platform only under the supervision and prior consent/ permission of a parent or legal guardian. We do not knowingly collect Personal Data from children under the age of 18. We have provided OTP based access to your account. You should keep this OTP confidential and not share it with anyone else including anyone who works for us. We have implemented commercially reasonable physical, electronic, procedural, administrative, and technical safeguards in a way that complies with the security requirements of data protection laws to protect your personal data, located in the countries where we are based from any unauthorized access. However, as effective as our security measures are, no security system is impenetrable. We cannot guarantee the security of these systems, nor can we guarantee that information supplied by you or on your behalf cannot be intercepted while being transmitted over the Internet.
